Compliance is non-negotiable

Complying with labour legislation is critical, and from time to time inspectors from the Department of Labour may visit to check up on this. Please take note of what to do in such a situation.

All employers and employees have certain rights and obligations in terms of employment. Labour inspectors are allowed to access any workplace without notice to conduct an inspection to make sure that all the rules and regulations are being followed.

They will inspect to make sure that the laws contained in the following Acts are being closely adhered to: 

  • Labour Relations Act
  • Basic Conditions of Employment Act (“BCEA”)
  • Compensation for Occupational Injury and Diseases Act
  • Employment Equity Act
  • Occupational Health and Safety Act
  • Unemployment Insurance Act.

If the company is found to be non-compliant with any of these Acts, the Department of Labour will issue a compliance order to be adhered to within 30 days. If the company fails to comply with the order, it could lead to punitive fines.
